Beartooth Tours - Acknowledgment of Risk

In consideration of the services of Beartooth Tours LLC, including its officers, agents, employees, drivers, and all other entities associated with this business (hereafter collectively referred to as "BT"), I agree to the following:

Acknowledgment of Risks

BT has taken reasonable steps to provide appropriate vehicles, equipment, and skilled guides to enhance my experience. However, BT has informed me that participating in a tour and its associated travel is not without risk. Certain risks are inherent to these activities and cannot be eliminated without altering the fundamental character of the tour. These inherent risks contribute to the uniqueness of the experience but may also result in loss or damage to personal property, accidental injury, illness, permanent trauma, or, in extreme cases, death.

BT does not intend to discourage participation but believes it is important for me to understand and acknowledge these risks. The following outlines some, but not all, of the potential hazards:

• Environmental and Terrain Risks: Slips, trips, and falls due to uneven or rugged terrain; falls into water, hydrothermal features, or from heights; exposure to mud pots, rivers, streams, and lakes.

• Wildlife and Natural Elements: Encounters with wildlife, insects, and other animals that may be unpredictable and potentially harmful.

• Weather and Climate Risks: Inclement weather conditions, extreme temperatures, high-altitude effects (e.g., altitude sickness, shortness of breath), and associated dangers such as frostbite, hypothermia, heatstroke, or severe sunburn.

• Food and Beverage Risks: Consumption of food and beverages during the tour may involve the risk of unknown allergens, contaminants, or foodborne illness.

Assumption of Risk and Responsibility

I acknowledge that the above list is not exhaustive, and there may be other unanticipated risks associated with my participation. I voluntarily accept full responsibility for any risks, whether identified or not, that could lead to personal injury, property damage, illness, or death.

I understand that participation in this tour may require specific skills and knowledge. I acknowledge that BT staff have been available to explain the nature and physical demands of the tour, along with the inherent risks. I certify that I am fully capable of participating in this activity and assume full responsibility for myself and any minor children under my care, custody, or control.

By signing this agreement, I waive and release Beartooth Tours LLC, its officers, employees, agents, and any affiliated entities from any liability for injuries, damages, or losses incurred due to inherent risks, hazards, or my own negligence while participating in this activity.

Additional Terms

• Seat Belt Requirement: All guests must wear seat belts while the vehicle is in motion. It is unlawful and unsafe to travel without a seat belt.

• Firearms Policy: Clients of Beartooth Tours LLC are NOT authorized to carry firearms.

I have carefully read and fully understand this agreement. By signing below, I acknowledge that this agreement shall be binding upon me, my heirs, assigns, personal representatives, and estate, as well as any minor children under my care.
